<br> to be transferred if the foreigner receives a portion or allowance
If a foreigner receives a share or share in an immovable property within Nepal, he shall not be entitled to have the property registered or registered in his name or to enjoy the income of the property except with the approval of the Government of Nepal. However, this arrangement will not be applicable in the case of non-resident Nepali citizenship holders.
(2) According to sub-section (1), if a foreigner receives a share or a grant, such foreigner shall transfer such property to a citizen of any kind and for such purpose, the relevant office shall issue a temporary land ownership certificate valid for the date of transfer of rights.
(3) In the case of a part received in the name of a foreigner as per sub-section (1) or a part of the property of Aputali, if it is not transferred to a Nepali citizen in accordance with sub-section (2) within three years of receiving such property, the Government of Nepal shall be entitled to such property after the expiry of the period.
